third-party use of trademarks

The following information concerns Logo programs under which third parties may license to use our trademarks, and information about obtaining other authorizations.

The trademarks and service marks of The Paliwoda Group, Inc. ("Paliwoda Group"; "we"; "us" ; "our") are valuable assets that we need to protect. We ask for your help in properly using and crediting our trademarks according to the following guidelines:

Permissible Use

The material on the Site is the property of The Paliwoda Group or others. Nothing contained on the Site shall be construed as conferring by implication, estoppel, or otherwise, any license or right to any copyright, patent, trademark or other proprietary right of The Paliwoda Group or any third party.

You may download, view, copy and print documents and graphics incorporated in these documents (the "Documents") from the Site subject to the following: (a) the Documents may be used solely for personal, informational, non-commercial purposes; and (b) the Documents may not be modified or altered in any way, including deletion or change to any of our copyright, trademark and other proprietary rights. Except where your use constitutes "fair use" under copyright law, you may not otherwise use, download, upload, copy, print, display, perform, reproduce, publish, license, post, transmit or distribute any information from this Web site — including, but not limited to audio, video, html code, buttons, graphic images, and text - in whole or in part, without our express authorization. We reserve all rights not expressly granted herein.

Relationship of Products or Services

You may indicate the relationship of your products or services to our products or services by using accurate, descriptive tag lines like "for Paliwoda Group database," "for use with Paliwoda Group Business Solution applications," and "works with Paliwoda Group software" in connection with your product or service name. Within text or body copy, such tag lines may appear in the same type as your product or service name. On product, packaging, advertising and other collateral where your product or service name is displayed apart from body copy, the tag line should appear in significantly smaller type than your name. You should also distinguish the tag line from your mark by using a different font or color. However, to avert any implication that we produce or endorse your product or service, "Paliwoda Group" or the tag line should never appear in blue color.

We permit use of our marks in single volume book titles (not magazines or periodicals) where such use is descriptive or referential. To avoid misleading the public as to our sponsorship, affiliation or endorsement, our mark must not appear more prominently than the rest of the title, and our logos must not be used on the cover. In addition, we request that you include a disclaimer of your association with The Paliwoda Group on the copyright page.

Prohibited Use

Your use of our trademarks should not be confused as our sponsorship, affiliation or endorsement of your product or service. Avoid using our marks as follows:

Company, Product or Service Names

Do not use our trademarks or potentially confusing variations as all or part of your company, product or service names. Please use an appropriate tag line as detailed above to note the relationship of your products or services to our products or services. For example, use "XYZ for Paliwoda Group database" instead of "Paliwoda XYZ" or "XYZ Paliwoda Group."

Please review our guidelines for Third Party use of Logos for more information.

Trade Dress

Do not imitate our trade dress, type style or logos. For instance, do not copy our packaging for use with your product, or display your product name in the distinctive logotype associated with our logo.

Domain Names

Do not use our trademarks or potentially confusing variations in your Internet domain name. This helps prevent confusion by Internet users about the source of the Web site.

Correct Use

Proper use of our trademarks reinforces their role as brands for our products and services, and helps prevent them from becoming generic names that can be used by anyone. Examples of former trademarks that became generic terms are "aspirin," "cellophane," and "escalator." You can help protect our investment in trademarks by adhering to the following rules:

Use a Generic Term

Use a generic term in association with each Paliwoda Group trademark the first time the mark appears in text, and as often as possible after that. You need not include generic names in headlines, package titles and documentation titles. For example, "Paliwoda Group software," "Paliwoda Group services," and "Paliwoda Group database."

Use as Adjectives

Our trademarks are adjectives and should not be used as nouns, or in the possessive or plural form. For example, use "Paliwoda Group database's benefits..." instead of "Paliwoda Group's benefits..."

Avoid Variations

Do not vary our trademarks by changing their spelling or abbreviating them. For example, use "Paliwoda Group eSolutions Suite" instead of "PG eSolutions."

Trademark Symbols and Credit Lines

Proper attribution of a trademark using symbols and credit lines increases public awareness of these marks, and helps prevent them from becoming generic terms. Credit lines also help clarify that they belong to us. Accordingly, we appreciate you attributing the ownership of our trademarks to us with trademark symbols (™ or SM or ®) and credit lines, as detailed below.

Trademark Symbols

Use the ™ symbol with the most prominent appearance of the "Paliwoda Group" mark on products, packaging, manuals, advertisements, promotional materials and Web pages (e.g., in the headline of an advertisement), and the first use of the mark in text or body copy. This includes situations where "Paliwoda" is a part of a product or service name (e.g., Paliwoda eSolutions™).

Headline: XYZ Develops New Product for Paliwoda eSolutions™
Body: XYZ Corporation, a member of The Paliwoda Group™, has developed the ABC software cartridge for use with the industry leading Paliwoda eSolutions business intelligence application. The ABC software cartridge is one of numerous products XYZ has developed that complement leading Paliwoda Group offerings.

"Paliwoda Group" receives a trademark symbol in the headline because this is the most prominent appearance, and when it appears as part of the "Paliwoda Group Partners Network" name because this is the first appearance in text. While there is no trademark symbol after "Paliwoda Group" when it appears in front of the term "products" and "offerings" since we already used a symbol the first time that the term "Paliwoda Group" appeared in body copy. It is always acceptable to continue using the ™ after "Paliwoda Group" throughout the document.

Credit Line

All products, packaging, manuals, advertisements, promotional materials and Web pages bearing our trademarks should include the following trademark credit line:

"Paliwoda Group eSolutions Suite, ProductScope360, telemego, and Kaizen Analytics are trademarks of The Paliwoda Group, Inc. and/or its affiliates."
The credit line may appear anywhere on the collateral, but typically is displayed on a copyright page, the back of a package or at the end of a document or Web page.

"Paliwoda Group" as a Trade Name

Trade names are the actual business names of companies. Trademarks and trade names are not the same, even though many companies use their trade names as trademarks. When you are using "Paliwoda Group" as a substitute for The Paliwoda Group, Inc., you are using it as a trade name. Because trade names are nouns, they can be used in the possessive and do not require a generic term or a trademark symbol. Thus, you should not use a ™ after "Paliwoda Group" when it appears as part of the full corporate name or as a trade name.
